The Gqeberha Regional Court has sentenced Mxolisi Gladman Hina (47) to life imprisonment for the rape of a 40-year-old woman in Missionvale on September 3, 2017. This conviction adds to Hina’s criminal history, as he was already serving an 18-year sentence for a similar offense committed in 2010 in Motherwell, for which he was sentenced in 2018.
The National Prosecuting Authority (NPA) spokesperson Luxolo Tyali said that on the night of the 2017 assault, the victim’s friend lured her to Hina’s residence, claiming that he had alcohol for them. After arriving, the friend stepped outside, leaving her alone with Hina.
He added, “When she attempted to follow, Hina blocked her path and violently raped her. Traumatised, the woman later escaped and sought refuge at a nearby neighbor’s home.”
He stated that the case encountered substantial delays due to the disappearance of a critical witness, the complainant’s friend.
“Community members allegedly assaulted the friend, suspecting her involvement in the attack, prompting her to go into hiding in Jansenville. Police later located her, and she testified despite her fears. Hina, who also evaded police, was eventually apprehended at his workplace,” he stated.
State prosecutor Wonga Jita, who also led the prosecution in Hina’s 2010 conviction, presented the evidence of the complainant and the neighbor who assisted her after the assault.
Prosecutor Jita argued for a life sentence, emphasising Hina’s repeated predatory behavior and the clear need for a punishment that would prevent him from posing further danger to society.
According to Tyali, Hina’s previous conviction involved the brutal rape of a pregnant woman who, unlike her friend, was unable to escape through a window to avoid his attack.
Welcoming the sentence, Eastern Cape Director of Public Prosecutions Barry Madolo praised the complainant’s courage, the prosecution team’s dedication, and the essential support provided by the Thuthuzela Care Centre and CPO.
“This life sentence sends a strong message that there is no tolerance for repeat offenders who commit acts of sexual violence. Hina’s actions reflect a serious, ongoing threat, and his conviction is a testament to our commitment to securing justice for survivors. The support of the Thuthuzela Care Centre was invaluable, offering the complainant comprehensive care, which empowered her to pursue justice with strength and resilience.”
