A 33-year-old man linked to the brutal assassination of New Brighton National Prosecuting Authority (NPA) prosecutor Tracy Brown made a brief court appearance today, marking a significant development in a case that has gripped the Eastern Cape legal fraternity.
Simthembele Xungu appeared at the Gqeberha Magistrates Court on 25 August, nearly a month after Brown was gunned down in a chilling attack that sent shockwaves through the community.
According to a statement issued by the Hawks, the suspect had reportedly fled to Johannesburg immediately after the assassination before being apprehended during a roadblock operation whilst travelling towards Gqeberha.
The 42-year-old prosecutor was murdered by four armed, masked assailants outside her Young Park residence on 31 July 2025, in front of her partner – an execution-style killing that prompted an intensive nationwide manhunt.
Xungu was finally apprehended in the early hours of 21 August, following weeks of intensive police investigations.

In a last-minute change that caught media off guard, the court appearance was moved from New Brighton Magistrate’s Court to Gqeberha Magistrate’s Court. By the time journalists arrived at the new venue, the suspect had already appeared before the magistrate.
The matter has been remanded for further investigation, with Xungu set to return to court on 3 September as authorities continue building their case against him.
The assassination has left the legal community reeling, with colleagues describing Brown as a dedicated prosecutor whose violent death represents an attack on the very foundations of South Africa’s justice system.
