The Langeberg Municipality has reiterated the regulations governing spaza shops to ensure compliance with the Langeberg Spaza Policy, adopted in April 2015 (Council Resolution A3108). These guidelines aim to balance economic activity with the preservation of residential areas’ safety, welfare and aesthetics
Application Process and Compliance
Applications are strictly evaluated, requiring full documentation such as site plans, proof of ownership, ID copies and payment of the prescribed application fee. Only property owners, family members or legal tenants residing on the property may operate a spaza shop. Municipal or state-owned properties are excluded.
Applications must be advertised, with written notices sent to neighbouring property owners for their comments. Health, building, and safety compliance are critical, with reviews conducted by the District Health Inspectorate, Building Inspectorate, Ward Committee and the South African Police Service. Town Planning also conducts an on-site inspection before making recommendations.
Council Review and Approval
The Municipal Council or a delegated authority evaluates applications based on merit.
Spaza shops must adhere to strict criteria:. The shop’s size may not exceed 25m² or 30% of the property’s total approved floor area.. The property must retain a primarily residential appearance and function.. Operating hours are limited to 07:00-21:00.. Shops must be at least 400 m from other business-zoned areas or spaza shops, except in designated economic zones.. Health regulations mandate proper ventilation, lighting, and the separation of shop spaces from bedrooms and toilets.
Enforcement and Consumer Responsibility
Spaza shops operating without Council approval are illegal, and their owners and operators face prosecution. Residents are encouraged to support only compliant businesses, identifiable by their displayed business licence and health certificate (Certificate of Acceptability) issued by the Cape Winelands District Municipality.
The municipality urges all prospective spaza shop operators to familiarise themselves with these requirements to avoid penalties and ensure their businesses contribute positively to the community.
