NGQAMAKHWE, Eastern Cape – Police have opened a criminal investigation following the circulation of a viral video that allegedly shows children as young as eight years old consuming alcohol on a beach in the Eastern Cape on Christmas Day.
The Ngqamakhwe South African Police Service (SAPS) confirmed on Tuesday that investigators had successfully traced the location of the incident to a household in the Khothane Administrative Area, Santini Location, near Ngqamakhwe.
According to the police statement, five children were allegedly involved in the incident – one 12-year-old, two 11 year olds, and two eight year olds. The video, which spread rapidly across social media platforms, has drawn widespread condemnation and calls for action to protect children.
Serious legal consequences
A criminal case has been registered under the National Liquor Act (Act 59 of 2003), specifically for supplying or making liquor available to minors. This offence carries serious penalties under South African law.
“The South African Police Service views this incident in an extremely serious light,” said Brigadier Nobuntu Gantana, Eastern Cape police spokesperson. “The National Liquor Act exists to protect the well-being of children, and any person found to be facilitating underage drinking will face the full might of the law.”

No arrests have been made at this stage of the investigation. Once the investigation is complete, the case docket will be submitted to the Office of the Director of Public Prosecutions, who will make the final decision on prosecutions.
Community responsibility
The incident has reignited debates about child protection and community responsibility during the festive season. Police have called on parents, guardians, and community members to prioritize child safety at all times.
The National Liquor Act prohibits the supply of alcohol to anyone under the age of 18, with violations potentially resulting in hefty fines or imprisonment.
