Langebaan police are warning residents that circulating images or visuals of wanted people or those suspected of committing a crime, including video footage, on social media platforms is illegal.
The local station says it has noted “with concern” that these materials are being widely spread. Langebaan police request members of the public to refrain from circulating such photographs or video footage as there can be consequences for circulating them.
Section 69(2) of the South African Police Service Act 68 of 1995 (amended in 1997) states: “No person may, without the written permission of the National or provincial Commissioner, publish a photograph or sketch of a person –
(a) who is suspected of having committed an offence and who is in custody pending a decision to institute criminal proceedings against him or her;
(b) who is in custody pending the commencement of criminal proceedings in which he or she is an accused; or
(c) who is or may reasonably be expected to be a witness in criminal proceedings and who is in custody pending the commencement of his or her testimony in such proceedings.”
According to Section 35(3) of the Constitution of the Republic of South Africa, 1996, “every accused person has the right to a fair trial.” The publication or circulation of such photographs and video footage can seriously hamper or jeopardise investigations, render the trial unfair and result in acquittal or withdrawal of the case.
Langebaan police appeal for cooperation from the public in this as well as assistance and cooperation from people serving as “admin” on social media groups.
They stress this is not intended to be an intimidation tactic, but to provide the community with information and limit the possibility of cases being withdrawn or acquitted in court.
