GQEBERHA – The murder case against the pair accused of brutally killing National Prosecuting Authority (NPA) prosecutor Tracy Brown has been postponed for three months for further investigation, the Gqeberha Regional Court heard today, 11 December.
Simthembele Xungu and Ayabulela Busakwe are charged with murder and conspiracy to commit murder. Busakwe also faces additional charges related to kidnapping with intent to commit human trafficking and extortion of Theresa Minnie (73) on 11 August 2025, which are Schedule 6 crimes under the South African Criminal Procedure Amendment Act. This means Busakwe is involved in two ongoing cases simultaneously.
PE Express previously reported that Brown was gunned down on 31 July in front of her partner at her Young Park residence after the suspects allegedly followed her home from the New Brighton Magistrate’s Court, where she worked at the time.
The State prosecutor requested that the matter be postponed as the investigations surrounding the case have not yet been completed. He also added that this postponement will allow the court sufficient time to finalise the investigation and transfer the case to the Gqeberha High Court.
Following the murder, the perpetrators allegedly fled in a recognisable Volkswagen Polo and nearly collided with another motorist. The other driver, who serves as a witness for the prosecution, made a positive identification of Xungu as an occupant of the fleeing vehicle.
The presiding magistrate confirmed that the matter is still under investigation and granted the postponement.
The matter was postponed until 3 March 2026 for further investigation. Both accused remain in custody.
