Hermanus – The trial of a Hermanus businessman accused of rape, sexual grooming and exposing a minor to pornography is set to begin at the Hermanus Magistrate’s Court on Monday, 21 September.

The accused, 42, has been in custody at Caledon since his arrest at his business premises in Hermanus on 9 June 2025. Bail has been refused at every appearance.

He faces three charges: rape, sexual grooming and the alleged exposure of a minor to pornography. Capt Buks Hanekom, head of the Hermanus Family Violence, Child Protection and Sexual Offences (FCS) Unit, confirmed the arrest at the time.

Police reportedly confiscated underwear and other items from the business premises during the arrest. Whether these items will be admitted as evidence remains for the court to determine and should not be construed as proof of guilt.

Behind bars since June

The accused appeared in the Hermanus Magistrate’s Court on 22 January, with subsequent appearances in the regional court on 25 February and 24 August. He has continued to plead not guilty.

The charges remain allegations. He is presumed innocent unless and until a court finds him guilty.

New evidence reported

Police have uncovered new evidence ahead of the trial. The nature of the material has not been made public. Should it be placed before the court, questions regarding its admissibility and weight will be determined during proceedings.

The trial will give the State the opportunity to present its case, while the defence may challenge the evidence and present its own arguments in accordance with criminal procedure.
