The Gauteng Division of the High Court in Johannesburg has dismissed businessman Oupa Brown Mogotsi’s urgent bail appeal, with the court finding he failed to present any genuine new facts to warrant his release.

Mogotsi faces five charges stemming from an incident that allegedly took place on 3 November 2025. The charges include unlawful possession of a firearm, unlawful possession of ammunition, unlawful discharge of a firearm in a built-up area or public place, defeating or obstructing the administration of justice, and perjury.

The Johannesburg Magistrates’ Court had previously refused his initial bail application. When Mogotsi returned to the same court with a second application based on what he claimed were new facts, that too was dismissed. He then took his case to the High Court on appeal.

Senior State Advocate Thami Mpekana opposed the appeal, arguing that Mogotsi had not presented any genuine new facts that would justify reconsidering bail. The State submitted that the issues raised had already been fully considered and determined during the previous bail proceedings, and that the so-called new evidence merely sought to reinforce arguments the court had already rejected.

In its judgment, the court agreed with the State’s position. The court found that the evidence Mogotsi relied upon was not genuinely new and merely attempted to revisit issues already considered and rejected during the initial bail proceedings.

A critical factor in the court’s decision was Mogotsi’s failure to establish a verifiable residential address, which remains central to determining whether the interests of justice permit an accused person’s release on bail.

The court concluded that no material misdirection had been demonstrated in the magistrate’s decision and that there was no basis for interfering with the lower court’s exercise of discretion.

NPA spokesperson Magaboke Mohlatlole welcomed the court’s decision. “The NPA welcomes the court’s decision, which reaffirms the importance of protecting the integrity of the criminal justice system and ensuring that judicial processes are not undermined or abused,” Mohlatlole said.

Mogotsi remains in custody pending the finalisation of his criminal case.
