CAPE TOWN – The Western Cape High Court sentenced the accused, a 49-year-old man from Kraaifontein, to life imprisonment for the rape of Daniel Jamneck and life imprisonment for his murder. He was further sentenced to ten years’ imprisonment for the rape of a Brackenfell woman and eight years’ imprisonment for the sexual assault of Daniel.
Action Society welcomed the sentencing of the “child predator” responsible for the rape and murder of eight-year-old Daniel Jamneck, saying justice has finally been served for a little boy whose life was brutally stolen.
The organisation, however, says its work is far from over and will continue to pursue accountability for the systemic failures that allowed a dangerous repeat sexual offender to remain free despite his violent criminal history.
The court also ordered that the accused be entered on the National Register for Sex Offenders, permanently prohibited him from working with children, prohibited him from possessing a firearm, and ruled that both Maria Jamneck and the rape victim will be entitled to make representations to the Parole Board should he ever become eligible for parole.
Justice served — but questions remain
“Today’s proceedings were marked by a powerful moment of solidarity as Daniel’s mother, Maria Jamneck, and the accused’s previous rape victim held hands in court as they awaited sentence,” says Juanita du Preez, Action Society’s head of operations.
“Two women whose lives had been forever changed by the same offender stood together in support of one another as justice was finally delivered.”
Earlier this week, the court heard Maria’s victim impact statement, in which she described Daniel as “our absolute light”, a compassionate little boy who loved nature, dreamed of becoming a veterinarian, and adored his younger sister.
She also spoke of the devastating trauma that continues to affect her family every day since Daniel’s murder.

“Today’s sentence brings justice for Daniel and recognises the immense suffering endured by Maria, Caren and everyone whose lives have been shattered by this monster,” says du Preez.
“Justice has finally been served. But we will continue our fight to expose the failures within the criminal justice system that allowed this accused to remain free and continue his crime spree, ultimately ending in Daniel’s death.”

Action Society accepted a mandate to support Daniel’s family after it emerged that the accused had previously been convicted of rape, later absconded from a court-ordered rehabilitation programme, and subsequently faced another attempted rape charge that was withdrawn before Daniel was raped and murdered.
The organisation will continue pursuing accountability for the institutional failures that allowed these warning signs to go unaddressed. “While today’s sentence closes one chapter in Daniel’s case, Action Society says the broader fight for systemic accountability is only beginning.”
Killed during a sleepover at friend
On 15 June 2023, Daniel was discovered dead in the bed of his friend’s father, the accused, during the early hours. The accused was taken into custody soon after. The original murder charge was broadened to include rape and sexual assault once post-mortem results were concluded.
Despite protesting his innocence throughout the proceedings, the accused faced overwhelming evidence, including testimony from his own son. The court heard that Daniël had been spending the night at a friend’s residence in Peerless Park North, Cape Town.
It later came to light that the convicted man had in 2007 entered into a plea agreement with the NPA regarding a crime in 2005 in which his previous victim, then 22, was drugged and sexually assaulted.
The case has stirred profound grief far beyond the courtroom walls. Justice for Daniël Jamneck, a group formed to follow the proceedings, exists for one simple purpose, to ensure that his story is never forgotten.
