HUMANSDORP – According to a report by Algoa FM, dramatic video evidence was presented in the Humansdorp Magistrate’s Court on 10 April, showing a Jeffreys Bay lawyer’s allegedly reckless driving behaviour just one day before a fatal collision that claimed the life of a 58-year-old woman.
Dieter Brandsetter, a 45-year-old attorney who heads Brandsetter Attorneys, is standing trial for the death of Dimitreau Bosman-Domingo in a crash that occurred on 3 January 2023 in Jeffreys Bay.
The prosecution alleges that Brandsetter was under the influence of drugs and alcohol when his Mercedes-Benz collided with the vehicle carrying Bosman-Domingo and her family members.
While Bosman-Domingo died in the accident, her husband and two other relatives survived the impact.
According to Algoa FM’s report, the attorney faces charges of murder, with culpable homicide as an alternative, along with reckless and negligent driving.
During proceedings on 10 April, State Prosecutor Johan Jansen introduced video footage to the court while witness Lindi Botha was giving testimony.
The recording allegedly captures Brandsetter’s driving conduct on the day before the accident occurred, showing his Mercedes-Benz alongside Botha’s vehicle and another white car.
The crucial evidence shows Brandsetter’s vehicle swerving into the path of oncoming traffic before correcting back into the left lane while approaching a speed bump.
Algoa FM reported that Botha confirmed to the court that the footage accurately reflected what she witnessed that day, stating her belief that Brandsetter had been driving recklessly.
However, Defence Advocate Tandeka Mashiyi challenged Botha’s testimony, arguing that she could not definitively link the reckless driving to the subsequent fatal accident.
According to Algoa FM, the trial has been postponed until 22 July, when proceedings will continue at the Gqeberha Regional Court.
Brandsetter remains out on bail, which has been extended pending the continuation of the case.
