Die staat het gister (Woensdag 23 April) sy saak gesluit teen die drie beskuldigdes wat van die ontvoering en verkoop van Joshlin Smith (7) beskuldig word.\n<\/p>\n\n\n\n

Boeta Appolis en Steveno van Rhyn staan saam met Joshlin se ma, Kelly Smith, tereg. Al drie het gister aangedui dat hulle hul swygreg uitoefen en dus nie gaan getuig of getuies gaan roep nie. \n<\/p>\n\n\n\n

Regter Nathan Erasmus het ook Van Rhyn en Smith se regsverteenwoordigers se aansoeke van die hand gewys om hul kli\u00ebnte onskuldig te bevind weens ‘n tekort aan bewyse. Ingevolge Artikel 174 van die Strafproseswet (Wet op Strafprosesreg 51 van 1977) kan ‘n hof ‘n beskuldigde van ‘n strafregtelike aanklag vryspreek indien daar aan die einde van die staat se saak geen bewyse aangebied is wat daarop dui dat die beskuldigde die oortreding gepleeg het nie. \n<\/p>\n\n\n\n

Joshlin is op Maandag 19 Februarie 2024 by die Saldanha-polisiekantoor as vermis aangemeld. Die polisie het ‘n grootskaalse soektog van stapel gestuur, maar ten spyte daarvan word Joshlin tot vandag toe nog vermis.\n<\/p>\n\n\n\n

Appolis, Van Rhyn en Smith het op 7\u2009Maart 2024 die eerste keer in die hof verskyn en die verhoor het op Maandag 3\u2009Maart vanjaar in die Veeldoelige Sentrum in White City, Saldanha, begin.\n<\/p>\n\n\n\n

Een van die laaste getuies in die staat se saak, lt.kol. Riaan Morris, ‘n kubermisdaadkenner, het video’s gewys wat in die ondersoek na die verdwene graadeentjie gebruik is. Een daarvan is Sondag 3\u2009Maart 2024 by ‘n verpolitiseerde gedenkdiens by die Diazville-gemeenskapsaal geneem, waar Smith in ‘n pienk broekpak op die verhoog rondloop. Shakira Ganief, ‘n sosialemediabe\u00efnvloeder, het vroe\u00ebr getuig dat sy di\u00e9 uitrusting vir Smith gekoop het en haar ook na die geleentheid geneem het.<\/p>\n\n\n\n

Smith het kop-in-die-hande begin huil met die speel van ‘n video-insetsel van di\u00e9 diens waarin ‘n vrou ‘n roerende liedjie vir Joshlin sing. Kelly het haar emosies in bedwang gekry, maar met die speel van die berugte “Spur-video” het sy weer begin huil toe sy haar twee jonger kinders sien. In die video rig die destydse aspirant-parlementslid Gayton McKenzie die selfoonkamera op Smith se jongste dogter en seun en gesels met hulle terwyl duisende mense ingeskakel is.\n<\/p>\n\n\n\n

Erasmus het op hierdie tydstip di\u00e9 spesifieke video laat stop en gevra dat die dele waar die twee minderjariges verskyn,\n<\/p>\n\n\n\n

vinniger vorentoe gespeel word. Hy het sy afkeer dat die gesigte van minderjariges op nasionale televisie en op sosiale media gewys word, duidelik gestel. \n<\/p>\n\n\n\n

“Al dra dit die goedkeuring van ander weg, gaan ek dit nie toelaat nie.” Kelly ontken deurentyd in die video dat sy enigiets met Joshlin se verdwyning te doen gehad het.\n<\/p>\n\n\n\n

Die hof het ook die insetsel gesien waar Kelly se suster, Michaela Daniels, wat vroe\u00ebr in die saak getuig het, ook met McKenzie in die Spur-onderhoud praat. Daniels beskuldig daarin vir Kelly dat sy weet waar Joshlin is omdat sy ges\u00ea het haar kind is steeds in die plakkerskamp.\n<\/p>\n\n\n\n

Adv. Aradhana Heeramin, wat die staat se saak saam met adv. Zelda Swanepoel behartig, het Morris nog video’s laat wys, waaronder ‘n televisieonderhoud waarin Boeta verskyn. ‘n Video is ook gewys waarin McKenzie en nog mans vir Van Rhyn in ‘n motor laai en dan met hom ‘n onderhoud voer. Van Rhyn sit met ‘n bord kos op sy skoot.\n<\/p>\n\n\n\n

Morris se verklaring met skakels na al die video’s is as die staat se laaste bewysstuk ingelewer.\n<\/p>\n\n\n\n

Van Rhyn se regsverteenwoordiger, adv. Nobahle Mkabayi, sowel as Smith se regsverteenwoordiger, adv. Rinesh Sivnarain, het hierna Artikel 174-aansoeke onsuksesvol voor die hof gebring. Die staat het die aansoeke teengestaan op grond van ‘n “goue draad van waarheid” wat deur die getuienis van Reze Lombaard geweef is. \n<\/p>\n\n\n\n

“Selfs al is daar onbetroubare aspekte in haar getuienis, is die goue draad steeds daar en ander getuienis staaf haar getuienis,” het Swanepoel afgesluit.\n<\/p>\n\n\n\n

Slotbeto\u00eb begin Dinsdag (29\u2009April) met uitspraak moontlik op Vrydag 2 Mei.<\/p>\n\n\n\n
