{"id":266290,"date":"2025-08-13T19:08:22","date_gmt":"2025-08-13T17:08:22","guid":{"rendered":"https:\/\/novanews.co.za\/udexpress\/schalk-burger-sr-skuldig-bevind-oor-belastingopgawes\/"},"modified":"2025-08-13T19:13:13","modified_gmt":"2025-08-13T17:13:13","slug":"schalk-burger-sr-skuldig-bevind-oor-belastingopgawes","status":"publish","type":"post","link":"https:\/\/novanews.co.za\/udexpress\/schalk-burger-sr-skuldig-bevind-oor-belastingopgawes\/","title":{"rendered":"Schalk Burger sr. skuldig bevind aan belastingontduiking"},"content":{"rendered":"\n<p>Die oud Springbok-rugbyspeler, Schalk Burger sr. en Welbedacht Wines (Edms) Bpk is deur die Paarl-landdroshof gevonnis nadat die hof vroe\u00ebr bevind het dat Burger sr. en die familiewynplaas skuldig is aan belastingontduiking nadat hulle versuim het om hul belastingopgawes in te dien.<\/p>\n\n\n\n<p>Die skuldigbevinding hou verband met \u2019n BTW201-opgawe vir die tydperk 02\/2023, asook \u2019n EMP201-opgawe vir die tydperk 03\/2023 wat nooit deur die maatskappy ingedien is nie. Dit het tot \u2019n boete van R6 000 op elke aanklag gelei, wat in geheel vir vyf jaar opgeskort is, luidens &#8216;n verklaring deur die Nasionale Vervolgingsgesag (NVG).<\/p>\n\n\n\n<p>Burger (69) is op sy beurt op 14 aanklagte skuldig bevind nadat hy sy versuim het om \u2019n BTW201-opgawe vir 02\/2023, \u2019n EMP201-opgawe vir 03\/2023 en IT12-inkomstebelastingopgawes vir die belastingjare 2011 tot 2022 in te dien.<\/p>\n\n\n\n<p>Hy is tot \u2019n boete van R6 000 of 12 maande gevangenisstraf op elke aanklag gevonnis, waarvan R2 000 of vier maande gevangenisstraf vir vyf jaar opgeskort is. Dit beloop \u2019n betaalbare boete van R56 000, of 112 maande gevangenisstraf, en \u2019n verdere R28 000 of 56 maande gevangenisstraf wat vir vyf jaar opgeskort is onder spesifieke voorwaardes. <\/p>\n\n\n\n<p>Hy het suksesvol by die hof aansoek gedoen om die boete uit te stel en is gelas om die R56 000 in paaiemente van R6 000 per maand, en \u2019n laaste paaiement van R8 000, te betaal.<\/p>\n\n\n\n<p>Die beskuldigde het \u2019n artikel 105A-pleit- en vonnisooreenkoms met die staat aangegaan. Die hof het die ooreenkoms bekragtig en die beskuldigde dienooreenkomstig skuldig bevind en gevonnis. <\/p>\n\n\n\n<p>Volgens die ooreenkoms het die beskuldigde erken dat die Welbedacht-wynlandgoed vir BTW geregistreer was (met aanspreeklikheidsdatum 1 September 2004) sowel as vir inkomstebelasting (met aanspreeklikheidsdatum 1 Januarie 2010) by die Paarl-kantoor van die Suid-Afrikaanse Inkomstediens (SARS), met Burger as openbare beampte vir al die maatskappy se belastingverpligtinge. Burger het versuim om die opgawes namens die maatskappy in te dien.<\/p>\n\n\n\n<p>Verder was Burger in sy persoonlike hoedanigheid sedert 1979 vir Inkomstebelasting by die Paarl-SARS-kantoor geregistreer. <\/p>\n\n\n\n<p>N\u00e1 sy suksesvolle registrasie vir e-filing in 2011 het hy versuim om sy IT12-inkomstebelastingopgawes vir die belastingjare 2011 tot 2022 in te dien ondanks die SAID se herhaaldelike pogings om alle belastingbetalers aan te moedig om hul opgawes in te dien. Eers n\u00e1 die instelling van \u2019n strafregtelike vervolging en nadat hy gedagvaar is om in die hof te verskyn, het hy al die uitstaande opgawes vir homself en sy maatskappy ingedien. Beide is tans belastingnakomend.<\/p>\n\n\n\n<p>Die beskuldigde se seun, Christiaan Burger (40), is sowat &#8216;n maand terug op 21 Julie 2025 ook op 12 aanklagte skuldig bevind en gevonnis weens die versuiming om sy persoonlike IT12-inkomstebelastingopgawes vir die tydperk 2011 tot 2022 in te dien.<\/p>\n\n\n\n<p>Hy is gevonnis tot \u2019n betaalbare boete van R48 000 of 96 maande gevangenisstraf, en \u2019n verdere R24 000 of 48 maande gevangenisstraf wat vir vyf jaar opgeskort is met voorwaardes. Hy was ook \u2019n direkteur van die Welbedacht-wynlandgoed, volgens die NVG se verklaring.<\/p>\n\n\n\n<p>&#8220;Die NVG verwelkom hierdie vonnisse aangesien dit \u2019n sterk afskrikboodskap op verskeie vlakke stuur,&#8221; lui die verklaring.<\/p>\n\n\n\n<p>&#8220;Met die indieningseisoen vir inkomstebelasting tans aan die gang, is dit \u2019n duidelike boodskap dat die versuiming van individue en regspersone om hul inkomstebelastingopgawes in te dien, nie geduld sal word nie. Dit is \u2019n ernstige oortreding wat die fiskus negatief be\u00efnvloed. Die burgers van Suid-Afrika word ook direk geraak indien belastingbetalers hul opgawes nie indien nie, aangesien dit verhinder dat hul belasting bereken en ingevorder word.&#8221;<\/p>\n\n\n\n<p>Die <em>Paarl Post<\/em> het uitgereik na die Burger-familie, maar hulle wou geen kommentaar lewer nie.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Burger het op 2 Junie 1984 in Gqeberha sy eerste toetswedstryd as deel van die Springbokspan teen Engeland gespeel. In 1986 het hy in die vier toetswedstryde teen die Nieu-Seeland Cavaliers gespeel en het altesaam ses keer vir die Springbokke uitgedraf. In Mei 2024 is die B\u00f4ll &amp; \u00d4ll-rugby-kletsprogram wat op eExtra sowel eTV uitgesaai was tydens &#8216;n geleentheid op die Welbedacht-wynlandgoed bekendgestel.
