The municipal building inspector had no problem with extending the top section for a recreational\/church space.\u201d <\/p>\n\n\n\n<p>However, in January 2021, when Adams applied to have a stoep added to the front of his shop the City \u201cdiscovered\u201d the building was not zoned for business\/commercial use, which he found hard to believe. <\/p>\n\n\n\n<p>\u201cSince I\u2019ve been in this building I\u2019ve paid business and commercial rates, so I don\u2019t understand how it could be zoned for residential use.<\/p>\n\n\n\n<div contenteditable=\"false\" data-embed24=\"Images\" data-pos=\"middle\" id=\"embed_b849945d\">\n<div class=\"slide\"><img decoding=\"async\" alt=\"\" data-smallsrc=\"https:\/\/cdn.24.co.za\/files\/Cms\/General\/d\/11286\/de9c1a28378740bd83d14ed9900ccea0.jpg\" src=\"https:\/\/novanews.co.za\/peoplespost\/wp-content\/uploads\/2025\/03\/802ea4bfc7654ea48f33099c627f8688.jpg\" title=\"Leon Adams closed his shop for more than three years to comply with a municipal bylaw zoning issue. PHOTO: <\/div>\n<div class=\"img_accreditation\"><\/div>\n<\/div>\n<\/div>\n\n\n\n<p>\u201cMy impression was that this building is zoned for business because there have always been shops in this building for the past 50 to 60 years.\u201d <\/p>\n\n\n\n<p>Following the compliance notice Adams closed the shop and applied for a rezoning. <\/p>\n\n\n\n<p>\u201cI was not allowed to operate the shop or church that has been here since 2006. When I purchased the shop from the previous shop owner he had been here for 20 years.\u201d <\/p>\n\n\n\n<p>More than three years later and the rezoning has still not been finalised. <\/p>\n\n\n\n<p>\u201cIt impacted us because we had to close everything immediately because the inspectors came out to say we were in contravention of the bylaw. <\/p>\n\n\n\n<p>\u201cBut the shop, right next door to me, in the exact same building and, in contravention of the same bylaw, is still open and operating.\u201d <\/p>\n\n\n\n<p>In a complaint, seen by People\u2019s Post, sent to the City in 2022, Adams questioned why he was forced to close while his neighbour was allowed to operate.<\/p>\n\n\n\n<div contenteditable=\"false\" data-embed24=\"Images\" data-pos=\"middle\" id=\"embed_8a534160\">\n<div class=\"slide\"><img decoding=\"async\" alt=\"\" data-smallsrc=\"https:\/\/cdn.24.co.za\/files\/Cms\/General\/d\/11286\/d2fd62123f734943907976bfc7f88ee9.jpg\" src=\"https:\/\/novanews.co.za\/peoplespost\/wp-content\/uploads\/2025\/03\/af3c99a049554281b73864a1f501ae9e.jpg\" title=\"The shop and church in Sibelius Avenue, Retreat, remains closed while another shop in the same building in contravention of the same bylaw was allegedly not forced to shut its doors. They received the same notice after I complained. <\/p>\n\n\n\n<p>\u201cI wrote emails to the City and complained because in terms of the zoning bylaw they are in the same boat as I am, so they should also be shut down and apply for the rezoning, but they are still open and operating today. <\/p>\n\n\n\n<p>\u201cDoes that mean that the bylaw was written for me only?\u201d <\/p>\n\n\n\n<p>Adams says it is simply unfair treatment. <\/p>\n\n\n\n<p>\u201cThere are thousands of households that have container businesses on their premises, violating this bylaw and, most importantly, the City is doing nothing about it.\u201d<\/p>\n\n\n\n<div 'segoe=\"\" arial,=\"\" class=\"OutlineElement Ltr SCXW78816707 BCX0\" sans-serif;\"=\"\" segoe=\"\" ui=\"\" ui',=\"\" verdana,=\"\" web',=\"\">\n<p class=\"Paragraph SCXW78816707 BCX0\" lang=\"EN-US\" paraeid=\"{41caf306-62bb-462a-abb3-31c03eca6839}{128}\" paraid=\"703402127\" xml_lang=\"EN-US\">Responding to the claims, Deputy Mayor Eddie Andrews said the City cannot force anyone to stop operating.&nbsp;<\/p>\n<div 'segoe=\"\" arial,=\"\" class=\"OutlineElement Ltr SCXW78816707 BCX0\" sans-serif;\"=\"\" segoe=\"\" ui=\"\" ui',=\"\" verdana,=\"\" web',=\"\">\n<p class=\"Paragraph SCXW78816707 BCX0\" lang=\"EN-US\" paraeid=\"{41caf306-62bb-462a-abb3-31c03eca6839}{135}\" paraid=\"2059728286\" xml_lang=\"EN-US\">&nbsp;\u201cThe City cannot force anyone to stop operating but takes action against the transgressors in terms of the Municipal Planning Bylaw (MPBL). In following due process, in terms of the MPBL, the City served Mr Adams with a notice and also, in terms of the MPBL, he had to pay an admission of guilt fine.\u201d&nbsp;<\/p>\n<div 'segoe=\"\" paraeid=\"{b226ea5b-3c90-4dc2-8e45-e26953686b13}{85}\" paraid=\"876821289\" xml_lang=\"EN-US\">&nbsp; \u201cThe owner\/operator has been taken to court and paid two admission of guilt fines thus the xml_lang=\"EN-US\">Commenting on the rezoning of Adam\u2019s shop, Andrews said the property is currently zoned as single residential and that the rezoning is currently in
