The total allocation of four months and ten days can be shared between parents as they see fit.<\/p>\n\n\n\n<p>Parental leave refers to time off from work that allows new parents to care for their child following birth or adoption.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-legal-background\"><strong>Legal background<\/strong><\/h3>\n\n\n\n<p>The Constitutional Court found sections of the Basic Conditions of Employment Act and corresponding Unemployment Insurance Fund legislation to be constitutionally invalid. These provisions previously created disparities in leave entitlements between birth mothers and fathers.<\/p>\n\n\n\n<p>&#8220;The court finds that the difference in the parental leave entitlement between birth mothers and fathers amounts to unfair and unconstitutional discrimination,&#8221; according to the SABC report.<\/p>\n\n\n\n<p>This ruling represents a significant step toward gender
