That means you should have a qualified attorney help you with it, to make sure it is correct and complete and valid. If you don\u2019t have legal assistance, your will might not comply with the law, and could be contested or overturned.<\/p>\n\n\n\n
What happens if you pass away and you do not leave a valid Will?<\/p>\n\n\n\n
If this happens, your assets will be distributed according to the provisions of the Intestate Succession Act. The provisions of this Act are generally fair and ensure that your possessions are transferred to:.<\/span> Your spouse and children, and.<\/span> Where applicable, your siblings\/parents, and.<\/span> If required, your extended family, if they depended on you financially in some way.<\/p>\n\n\n\n \n Difficult terms explained<\/b>\n<\/p>\n\n\n\n Estate: Everything that belongs to you \u2013 all your assets. (However, your retirement fund benefits are excluded, as these are distributed according to the Pension Funds Act, and your Nomination of Beneficiary\/Expression of Wish form is used to guide your Fund\u2019s Trustees in this regard.)<\/p>\n\n\n\n Executor: The person appointed to see to the administration of your estate once you have passed away.<\/p>\n\n\n\n However, this might not be what you want, and the following could happen:.<\/span> Your assets may not be left to the person of your choice..<\/span> If you do not have a Will, there is no-one to execute your wishes..<\/span> It can take a very long time to have an executor appointed..<\/span> The executor who is appointed will be somebody you did not choose..<\/span> There can be extra and unnecessary costs.<\/p>\n\n\n\n You can make things easier and less stressful for your family by ensuring you have a valid and up-to-date Will.
