Mzumanzi Zwakala, die weermaglid wat saam met sy vriend David Kangombe aangekla word van die moord op ‘n matriekleerling voor sy ouerhuis. Hy het in die getuiebank in die hooggeregshof in Kimberley ges\u00ea hy het daardie aand net \u0149 waarskuwingskoot in die lug gevuur.<\/p>\n\n\n\n
Amogelang Assegaai was \u0149 matriekleerling aan die Kimberley Boys’ High School. Hy is op Sondag 23 Oktober 2022 voor sy ouerhuis in Verwoerdpark in Kimberley in die Noord-Kaap doodgeskiet. <\/p>\n\n\n\n
Die staat voer aan die twee beskuldigdes (albei 48) het weens \u0149 geskil oor \u0149 verlore selfoon saamgesweer om die oorledene te skiet. Daarom het hulle daardie aand op dieselfde tydstip hul selfone afgeskakel sodat dit nie nagespeur kan word nie.<\/p>\n\n\n\n
Die skoot is glo van naby afgevuur. Die koe\u00ebl het die oorledene in die linkerskouer ingedring en sy longe en hoofslagaar deurboor. Hy is op die toneel dood.<\/p>\n\n\n\n
Die verdediging het aangedui dat hulle van die bevindings in die ballistiese- en die lykskouingsverslag betwis.<\/p>\n\n\n\nDie oorledene, Amogelang Assegaai.<\/figcaption><\/figure>\n\n\n\n
Gesels oor verlore selfoon<\/h4>\n\n\n\n
In kruisondervraging op Donderdag 3 April het Zwakala aangevoer dat sy seun, Kamwa Zwakala, die Vrydagaand “ernstig” deur \u0149 groep vriende met \u0149 bierbottel aangerand is. Sy selfoon het weggeraak. Die seun het \u0149 seer rug en blou oog gehad, moes steke kry, en een tand was uit. Daarna het sy pa verskeie kere met Assegaai gepraat en ge\u00ebis dat die foon teruggegee word.<\/p>\n\n\n\n
Volgens Zwakala wou hy nie \u0149 saak van aanranding by die polisie aanhangig maak voordat hy nie eers met Assegaai se ouers gepraat het nie.<\/p>\n\n\n\n
Daardie Sondagmiddag het Kangombe, wat Zwakala gereeld rondgery het omdat Zwakala \u0149 swak knie het, sonder sy vuurwapen na Assegaai se huis gegaan om die foon te kry. Zwakala het deurentyd aangevoer hy wou met die seun se ouers praat. Hy het nie met Assegaai baklei nie. Hy het \u201crespekvol met die seun gesels oor die verlore selfoon\u201d. Volgens die staat het Assegaai hom vertel wie vir Kamva vroe\u00ebr aangerand het.<\/p>\n\n\n\n
Die staat voer aan Zwakala het kwaad geword nadat \u0149 buurvrou ges\u00ea het sy seun praat nie die volle waarheid oor die voorval nie. Hy het omstanders gedreig dat hy \u0149 vuurwapen het en \u201cKimberley klein sal maak vir hulle\u201d.<\/p>\n\n\n\n
Konflik in donker<\/h4>\n\n\n\n
Zwakala voer aan hy was agter die stuurwiel toe hulle \u0149 tweede keer daardie aand na Assegaai se huis is. Kangombe was glo weens ‘n ongesteldheid nie saam nie. Assegaai het die selfoon gekry en wou dit teruggee. Zwakala het sy vuurwapen saamgevat en agter sy rug in sy belt ingedruk want hy bang was hy word gekaap. Dit was glo te donker om te sien dat daar \u0149 voertuig in die rylaan by Assegaai se ouerhuis was. Volgens hom het hy en sy seun op die sypaadjie met Assegaai gepraat.<\/p>\n\n\n\n
Die staat voer egter aan Assegaai het die selfoon oorhandig. Daarna het Kamva daarmee in die voertuig geklim en gemerk dat die foon beskadig en die sim- en geheuekaart weg is.<\/p>\n\n\n\n
Zwakala het vir Assegaai hieroor uitgevra. Assegaai het hom glo bespring en gewurg. Zwakala het hom hard weggestamp. Dit is toe dat hy die waarskuwingskoot in die lug opskiet, \u201cwant jy weet nie wat Assegaai volgende gaan doen nie\u201d. Boonop het Assegaai glo in Zwakala se pad gestaan om sy kar te bereik. Zwakala was glo ook bang \u0149 hond kon op hom afstorm. Hy moes toegee dat daar nie \u0149 hond was nie.<\/p>\n\n\n\n
Hy het ontken dat hy sterker en gewigtiger is as Assegaai, \u0149 seun wat 65kg weeg. Op daardie tydstip het Assegaai stilgestaan en niks ges\u00ea nie. Volgens hom was Kamva weens sy beserings nie in staat om tussenbeide te tree of weens sy gebreekte tand nie in staat om te skreeu nie.<\/p>\n\n\n\nMzumanzi Zwakala op 3 April in die getuiebank in die hooggeregshof in Kimberley. \u201cJy skiet \u0149 skoot af terwyl jou seun ook daar staan?\u201d het adv. Sue-Anne Weyers-Gericke, aanklaer gevra, waarop Zwakala “ja” geantwoord het. <\/p>\n\n\n\n
Zwakala voer aan Assegaai het toe in die huis in gehardloop. Daarna het hy en sy geselskap vertrek. Hy ontken dat Kamva reeds daardie aand \u0149 boodskap gekry het dat Assegaai dood is. Zwakala het glo later na Assegaai se foon gebel om te hoor waar die verlore simkaart en geheuekaart is. Volgens die staat verskyn die beweerde oproep nie in die selfoongebruikstaat nie. Hy probeer homself distansieer van die wete dat die seun daardie aand dood is.<\/p>\n\n\n\n
Hy s\u00ea hy het die volgende dag \u0149 saak van aanranding teen Assegaai en die afvuur van \u0149 vuurwapen in \u0149 beboude gebied by die polisiekantoor aangemeld. Daar het hy toe vir die eerste keer van die seun se dood gehoor.<\/p>\n\n\n\n
Zwakala het n\u00e1 sy getuienis sy saak gesluit, en Kangombe het sy saak gesluit sonder om te getuig.<\/p>\n\n\n\n
