\u2019n Waarskuwing oor die onwettige verspreiding van elektroniese koerante en tydskrifte is aan die einde van Januarie uitgereik in die saak teen twee vroue van Oudtshoorn wat verskeie elektroniese publikasies van Media24 onwettig versprei het.<\/p>\n\n\n\n

Die hooggeregshof in Kaapstad het bevind die vroue het Media24 se outeursreg geskend toe hulle die elektroniese koerante en tydskrifte oor \u2019n tydperk op \u2019n WhatsApp-groep versprei het.<\/p>\n\n\n\n

Regter Monde Samela het op 29 Januarie Media24 se aansoek, wat in Desember verlede jaar ingedien is, aangehoor.<\/p>\n\n\n\n

Die aansoek is teen Christa Gorgens (57) en Leanda van den Berg (56) ingedien om hulle te verhoed om enige werk van Media24 onwettig te versprei en om finansi\u00eble verliese van hulle te verhaal. <\/p>\n\n\n\n

Hulle het nie die aansoek teengestaan nie en was nie in die hof nie.<\/p>\n\n\n\n

Gorgens en Van den Berg was die administrateurs van die \u201cKoerante en Tydskrifte-Groep\u201d op WhatsApp waaraan sowat 900 mense behoort.<\/p>\n\n\n\n

In die aansoek het Ishmet Davidson, uitvoerende hoof van Media24, \u2019n bevel teen die vroue gevra omdat hulle Media24 se outeursreg geskend het toe hulle sonder toestemming PDF-weergawes van die groep se koerante, tydskrifte, e-publikasies en plaaslike koerante op die Whats\u00adApp-groep versprei het.<\/p>\n\n\n\n

\u2019n Interdik is ook toegestaan wat die vroue verbied om die outeursreg van enige van di\u00e9 publikasies of nuwe titels te skend. <\/p>\n\n\n\n

Die interdik geld ook enige liter\u00eare werk of kunswerke in die publikasies.<\/p>\n\n\n\n

Hoewel die saak nie oor die deel van boeke gehandel het nie, is dit wat gedoen is, wel onwettig.<\/p>\n\n\n\n

Davidson het in sy be\u00ebdigde verklaring as voorbeeld Jacques Pauw se The President\u2019s Keepers<\/em> gegee as een van die boeke wat op hierdie soort onwettige manier versprei is. <\/p>\n\n\n\n

Die hof het gelas dat die vroue geen elektroniese publikasie van die Media24-groep sonder toestemming mag versprei nie. <\/p>\n\n\n\n

Hulle is ook met die koste van die saak gelas. <\/p>\n\n\n\n

Hulle moet hul selfone aan Jeremy Speres, Media24 se regsverteen\u00adwoordiger, oorhandig. Dit sal gebruik word om te bepaal wat die tanti\u00e8me vir die werk is wat hulle gedeel het, die skade wat Media24 gely het en die rente daarop, waarna dit aan Media24 betaal moet word.<\/p>\n\n\n\n

Davidson het die bevel verwelkom. Hy s\u00ea die saak skep \u2019n presedent, met \u2019n regter wat die eerste keer beslis het dat die ongemagtigde verspreiding van materiaal met kopiereg wel onwettig is.<\/p>\n\n\n\n

\u201cDie onwettige reproduksie en verspreiding van koerante en tydskrifte kos die mediabedryf elke jaar miljoene rande net aan verlore inkomste. <\/p>\n\n\n\n

\u201cDit hou \u2019n ernstige bedreiging vir die lewensvatbaarheid van gehaltejoernalistiek in, wat baie duur is om te skep, en vir die noodsaaklike rol wat die media in ons brose demokrasie speel,\u201d s\u00ea hy.<\/p>\n\n\n\n

\u201cKopiereg is heilig vir die volhoubaarheid van \u2019n onafhanklike media, en Media24 bly daartoe verbind om dit tot elke prys te beskerm.\u201d<\/p>\n\n\n\n
