‘n Boer van die Kenhardt-distrik in die Noord-Kaap het in die hooggeregshof in Kimberley gese\u00ebvier nadat sy aansoek geslaag het en hy onmiddellik toegang tot sy huis en die besit van sy persoonlike eiendom moet terugkry nadat hy onregmatig van die plase Warmbad Noord en Warmbad Zuid uitgesluit is.<\/p>\n\n\n\n

Die geskil het ontstaan nadat Andries Swart op 17 Mei van die Afrika Burn-fees<\/a> in die Tankwa teruggekeer het en gevind het dat hy uitgesluit is. Die hekslotte en slotte van sy huis was verander en die plaasbestuurder het ges\u00ea hy is \u201conwelkom\u201d.<\/p>\n\n\n\n

Swart het die plase in 2024 vir miljoene rande aan ‘n Britse sakeman verkoop met die ooreenkoms dat hy sal aanbly en oorhoofs na die infrastruktuur sal omsien.<\/p>\n\n\n\n

Ingevolge die ooreenkoms kon hy ook ‘n aantal vee en wild aanhou. Hy sou ook die skuur en sekere kampe gebruik. Ook sou hy lewenslank die reg h\u00ea om gratis in die hoofkompleks te woon en sy vee op die grond te laat wei, in ruil vir bestuurdienste wat hy aan die maatskappy sou lewer. Intussen het Swart ook ‘n karavaan aangeskaf waarmee hy kan rondreis.<\/p>\n\n\n\n

Volgens hofdokumente is Swart in Mei meegedeel dat die slotte van die geboue op instruksie van Frederick Mark Slemeck, die eienaar van Gariep Systems (Edms) Bpk, verander is.<\/p>\n\n\n\n

Die verweerders, Gariep Systems en Slemeck, het egter aangevoer dat Swart die ooreenkoms verbreek het n\u00e1 ‘n beweerde voorval van aanranding op ‘n werker. Hulle het geweier om hom toegang tot die plaas te gee tensy hy die kansellering van die ooreenkoms onderteken, wat Swart geweier het om te doen.<\/p>\n\n\n\n

Optrede kom neer op ‘selfhelp’<\/h3>\n\n\n\n

Regter Mpho Mamosebo het in haar uitspraak bevind die optrede van die verweerders kom neer op “selfhelp”, wat onaanvaarbaar in die Suid-Afrikaanse regstelsel is.<\/p>\n\n\n\n

Die regsmiddel van mandament van spolie wat Swart in sy aansoek gebruik het, is juis daar om te verhoed dat mense die reg in eie hande neem. <\/p>\n\n\n\n

Mandament van spolie<\/a> (spoliasie-remedie) is ‘n gemeenregtelike regsmiddel in die Suid-Afrikaanse reg wat gebruik word om die status quo ante (die oorspronklike toestand) onmiddellik te herstel wanneer iemand onregmatig van hul goedere ontneem is sonder om die behoorlike regsproses te volg. Dit laat die benadeelde party toe om besit van die onwettig gekonfiskeerde goedere deur middel van regshulp terug te kry.<\/p>\n\n\n\n

Volgens die hof moet Swart se besit herstel word voordat enige verdere regstryd oor die kontrak self kan plaasvind.<\/p>\n\n\n\n

Die bewering van aanranding het niks met die uitsetting te make nie. Boonop het Slemeck op hoors\u00ea gesteun. Hy het beweer die plaasbestuurder het hom van Swart se beweerde aanranding op ‘n plaaswerker vertel, maar Slemeck het geen eedsverklarings van die plaasbestuurder en die plaaswerker aan sy hofstukke geheg nie.<\/p>\n\n\n\n

Swart ontken die aanrandingsvoorval.<\/p>\n\n\n\n

Die feit dat Swart sy vee, voertuig en selfs gelisensieerde vuurwapens op die plaas moes agterlaat terwyl hy uitgesluit was, het die dringendheid van die saak beklemtoon.<\/p>\n\n\n\n

Gariep Systems en Slemeck is deur die hof beveel om onmiddellik Swart se besit van die plase te herstel en alle sleutels, afstandbeheerders en toegangskaarte aan hom te oorhandig. Enige slotte of kettings moet verwyder word wat aangebring is om hom uit te sluit.<\/p>\n\n\n\n

Bestraffende kostebevel uitgereik<\/h3>\n\n\n\n

Omdat hulle reg in eie hande geneem het, het die hof ‘n bestraffende kostebevel teen hulle uitgereik. Hulle is beveel om Swart se regskoste op ‘n skaal tussen prokureur en kli\u00ebnt te betaal.<\/p>\n\n\n\n

Die meriete van die beweerde kontrakbreuk en die aanrandingsklag sal moontlik later in ‘n arbitrasieproses hanteer word, maar vir nou moet Swart ongestoord na sy tuiste kan terugkeer.<\/p>\n","protected":false},"excerpt":{"rendered":"
