Sugte van verligting is gehoor en trane het Donderdag 20 November in die hooggeregshof in Kimberley gevloei toe Alberto Linden Matthews\u00a0(47) onder meer daaraan skuldig bevind is dat hy sy gewese vrou, Mandy Bailey (43), op 27 Desember 2023 by haar huis in Beaconsfield, Kimberley, met ‘n verbode 7.65 mm pistool doodgeskiet het.<\/p>\n\n\n\n

Di\u00e9 saak het groot opspraak verwek en die hofsaal was vol naasbestaandes en oud-kollegas van Bailey wat vir die Noord-Kaapse departement van samewerkende regering gewerk het.<\/p>\n\n\n\n

Waarnemende regter Danie Olivier het Matthews benewens moord ook skuldig bevind aan\u00a0twee aanklagte van poging tot moord omdat hy die vuurwapen op twee Bailey-familielede tydens die voorval gerig het. Matthews het die vuurwapen probeer afvuur, maar dit het geweier.\u00a0 Hy het ook die beskermingsbevel wat Bailey teen hom verkry het, oortree. Die veroordeelde is ook skuldig bevind aan die onwettige besit van \u2019n vuurwapen waarvan die reeksnommer afgevyl is (verbode handwapen) en ammunisie.<\/p>\n\n\n\n

Hy is onskuldig bevind aan huisbraak met die doel om ‘n misdryf te pleeg en aan aanranding met die doel om ernstig te beseer omdat die staat nie sy saak kon bewys nie.<\/p>\n\n\n\n

Matthews as getuie het sy eie verklaring en weergawes wat aan getuies gestel is, weerspreek wat die regter allermins be\u00efndruk het. Vrae oor sy teenstrydighede met ander getuies se weergawes het hy ontwyk of bloot ontken sonder om verder te verduidelik.<\/p>\n\n\n\n

Die regter het die ander getuies, onder wie Matthews se niggie, as geloofwaardig beskou. Hul getuienis het mekaar grootliks gestaaf.<\/p>\n\n\n\n

Minderjarige sien skietvoorval<\/h3>\n\n\n\n

Uit die getuienis blyk dit Matthews en Bailey is reeds twee jaar vantevore geskei. In November 2023 het hy na haar huis gegaan waarna ‘n rusie uitgebreek en ‘n struweling ontstaan het.\u00a0 Bailey het daarna ‘n beskermingbevel teen hom bekom wat op 11 Desember op hom beteken is. Hy het erken hy het dit ontvang en die inhoud verstaan. Hoewel hy onskuldig gepleit het, het hy vinnig erken hy het die voorwaardes daarvan oortree deur na haar huis te gaan op die dag van die voorval.<\/p>\n\n\n\n

Die getuies het aangevoer hy het al sy besittings in November 2023 verwyder, hoewel die regter nie oortuig is of hulle presies sou weet of dit al sy besittings was nie. Matthews het aangevoer hy wou op die dag van die voorval sy dokumente en sy motor se spaarsleutel gaan haal.<\/p>\n\n\n\n

Die regter aanvaar dat iemand daardie dag die motorhek vir hom oopgemaak het, maar Matthews het die huis betree met die oopmaak van die toe hek en deur aan die agterkant van die huis om in die huis te gaan.<\/p>\n\n\n\n

Volgens die getuies het Matthews met ‘n handwapen in die huis ingekom. Di\u00e9 getuies sluit Bailey se minderjarige dogters, haar broer, Wesley Bailey, en sy minderjarige dogter in. Matthews het Bailey glo voorheen met die dood gedreig. Die minderjarige dogter wat in die kamer saam met Bailey was, het gesien hoe Matthews in die kamer kom en haar ma skiet. Haar ma het na die badkamer gestrompel, Matthews het weer geskiet en haar ma het op die grond geval.<\/p>\n\n\n\n

Wesley en die ander meisies in die huis het twee skote hoor afgaan. Toe hulle naderstorm, het Matthews uit die kamer gekom en die vuurwapen op hulle gerig om te skiet, maar vloekend gevlug toe die vuurwapen weier.<\/p>\n\n\n\n

‘Iets verskriklik aangevang’<\/h3>\n\n\n\n

Volgens Matthews het hy nooit ‘n vuurwapen saamgevat nie. Hy het twee teenstrydige weergawes gehad oor wat gebeur het. In een weergawe het hy in die sitkamer gaan sit en wag dat Bailey sy besittings bring, waarna haar broer Wesley op hom geskreeu het. In sy ander weergawe het hy na haar kamer gegaan, sy het aggressief geraak, haar gewapende\u00a0broer het ingekom en ‘n skoot het afgegaan, waarna Matthews gevlug het.<\/p>\n\n\n\n

Matthews se niggie, Kim Taaibos, het egter getuig toe hy by haar huis aankom, het hy ‘n blou baadjie aangehad en ges\u00ea hy iets verskriklik aangevang. Toe sy op sosiale media van die voorval lees, het hy gebieg dat hy Bailey geskiet het. Hy het vertel van die konfrontasie en dat hy van die ander familielede ook wou skiet, maar die vuurwapen het geweier. Dit is bevestig deur die lewendige patroon wat op die toneel gevind is te midde van ander patroondoppies.<\/p>\n\n\n\n

Die polisielede wat hom in hegtenis geneem het, het getuig hy het erken die blou baadjie was syne. Die vuurwapen in die baadjiesak het sewe lewendige patrone in gehad. Dis di\u00e9 vuurwapen wat Bailey se dood veroorsaak het.<\/p>\n\n\n\n

Matthews het probeer ontken dat die blou baadjie syne is, asook die vuurwapen daarbinne.<\/p>\n\n\n\n

Die regter het bevind hy kon ook nie verduidelik hoe Wesley, wat volgens Matthews die skieter was, se vuurwapen in sy blou baadjie by sy niggie se huis kon beland nie.  <\/p>\n\n\n\n

Adv. Leshnee Pillay het aangekla, en adv. Obatlile Maroke het Matthews verdedig.<\/p>\n\n\n\n

Die vonnisoplegging is tot 27 November uitgestel.<\/p>\n\n\n\n
