Terwyl Steven Jonkers (55), eertydse Noord-Kaapse departementshoof van gesondheid op Maandag 11 Augustus in die hooggeregshof in Kimberley vrygespreek is, is Renier van Rooyen <\/a>(62), sy vennoot Claudius Gerald Peterson <\/a>(57) en hul maatskappy Defensor Electronic Security Systems aan bedrog skuldig bevind.<\/p>\n\n\n\n

Die hofsaak wat meer as twee jaar geduur het, het ‘n kontrak behels wat in 2017 toegestaan is vir sekuriteitsdienste van R384 miljoen by die Noord-Kaapse departement van gesondheid. Die kontrak is later herhaaldelik verleng.<\/p>\n\n\n\n

Jonkers<\/a> is deesdae adjunk-direkteur-generaal in die kantoor van die Noord-Kaapse premier. Hy is reeds vroe\u00ebr vrygespreek op aanklagte van bedrog.<\/p>\n\n\n\n

Maandag is hy onskuldig bevind dat hy destyds as rekenpligtige beampte oortredings van die Wet op Openbare Finansies begaan het deur die bod aan Defensor toe te staan. Luidens die uitspraak kon hy sonder om magtiging van die Tesourie te verkry en ingevolge sy magte met die diensverskaffer verder onderhandel voordat die diensleweringkontrak onderteken is.<\/p>\n\n\n\n

‘Wanvoorstellings van tenderdokumente gemaak’<\/h3>\n\n\n\n

In sy akte van beskuldiging het die staat aangevoer die beskuldigdes het van 13 Maart 2014 tot 20 Oktober 2017 geheul en wanvoorstellings in tenderdokumente gemaak om die departement te bedrieg.<\/p>\n\n\n\n

Die staat het bedrog op ‘n aantal gronde aangevoer soos: Defensor se belastingklaringsertifikaat wat as deel van die bod ingedien is, is nie deur Suid-Afrikaanse Inkomstediens (SAID) uitgereik nie; hy het nie die vereiste registrasiesertifikaat van die Reguleerder vir die Private Veiligheidsbedryf (Prisa) gehad nie; en Van Rooyen en Peterson het botsende belange in ander entiteite gehad. ‘n Ander entiteit, Camguard, wat toe reeds gederegisteer was, se BTW-nommer is glo op boddokumente misbruik as di\u00e9 van Defensor Electronic Security Systems. Die maatskappy het met wanvoorstellings voorgegee hulle is bevoeg om die bod te verkry.<\/p>\n\n\n\n

Volgens waarnemende regter Omphemetse Chwaro het Van Rooyen en Peterson wederregtelik hul ander maatskappy, Defensor Security, se Prisa-registrasienommer as deel van hul boddokumente ingedien. Die betrokke entiteit wat die bod ingedien het, was nie geregistreer nie; dit is eers twee maande later gedoen. Hulle het op onregmatige wyse nie die departement van di\u00e9 belangrike afwyking van die vereistes ingelig nie. Daarmee het hulle artikels van die wet op Prisa oortree.<\/p>\n\n\n\n

Die regter aanvaar die twee se verweer dat hulle nie botsende belange gehad het nie, omdat geen van hulle familielede in die departement werksaam was nie. Die staat kon nie bewys dat Defensor ingevolge die bodprosesse wat gevolg is, uiteindelik nie gekwalifiseer het nie.<\/p>\n\n\n\n

Regter Chwaro het bevind Van Rooyen en Peterson sou nie geweet of besef het hul belastingklaringsertifikaat wat hulle van die SAID verkry het, bevat verkeerde inligting nie. Nie een van die getuies het klinkklaar bevestig dat SAID nie die sertifikaat uitgereik het nie soos die staat aangevoer het. Daar was glo tegniese probleme met die SAID se rekenaarstelsel op die betrokke tydstip. Volgens die regter was al 19 getuies geloofwaardig.<\/p>\n\n\n\n

Intussen is \u0149 bevel aan die nasionale beslagleggingseenheid toegestaan om ingevolge die Wet op die Voorkoming van Georganiseerde Misdaad ‘n kommissie van ondersoek te hou oor hoe die veroordeeldes wederregtelik sou baat by die kontrak.<\/p>\n<\/blockquote>\n\n\n\n

Van Rooyen en Peterson se borgtog is verleng. Hul vonnisverhoor is tot 17 November uitgestel.<\/p>\n\n\n\n
