Die lewensmaat van wyle regter Yvonne Mokgoro, wat aangekla word dat hy as motorbestuurder haar dood in ‘n botsing met ‘n vragmotor veroorsaak het, het op Vrydag 8 Augustus nog ‘n terugslag in die siviele hooggeregshof in Kimberley gehad.<\/p>\n\n\n\n

Dit kom nadat die eis van Mokgoro se naasbestaandes suksesvol was om haar laaste testament wettig te laat verklaar, ‘n aansoek wat David Mmelesi teengestaan het. Mmelesi moet na dese sy eie en ook die kinders se regskoste betaal.<\/p>\n\n\n\n

Uit hofdokumente blyk dit Mokgoro het haar testament sedert 2014 verander. Waar Mmelesi voorheen ook haar huis in ‘n spog-gholflandgoed sou erf, erf hy luidens haar 2021-testament net ‘n Jeep Wrangler.<\/p>\n<\/blockquote>\n\n\n\n

Mokgoro was ‘n vermaarde regter<\/a> wat die Orde van die Kremetart ontvang het en was tydens haar dood ‘n afgetrede regter van die grondwetlike hof. Sy was die eerste swart vroulike regter in Suid-Afrika en voormalige regter in die grondwetlike hof. Gedurende haar regsloopbaan het sy ‘n aantal regskursusse by universiteite in Suid-Afrika, die Verenigde State, Nederland en die Verenigde Koninkryk aangebied.<\/p>\n\n\n\n

Mmelesi word van strafbare manslag aangekla n\u00e1 die ongeluk<\/a> waarin hy en Mokgoro op 3 April 2023 omstreeks 20:00 betrokke was. Hulle was onderweg van Kimberley na Warrenton toe hy na bewering in hul Mercedes-voertuig teen ‘n vragmotor gebots het. Mokgoro, toe reeds afgetree, is ernstig beseer.\u00a0Sy is op 9 Mei 2024 weens haar beserings oorlede.<\/p>\n\n\n\n

N\u00e1 haar dood het landsvlae halfmas gehang en het sy \u2019n kategorie een amptelike begrafnis gehad waar oudhoofregter Raymond Zondo en president Cyril Ramaphosa haar lof besing het.<\/p>\n\n\n\n

Testament se geldigheid betwis<\/h3>\n\n\n\n

Dit blyk uit die hooggeregshofuitspraak van regter Lawrence Lever dat Mmelesi ‘n rusie met Mokgoro se kinders oor die geldigheid oor ‘n testament van 2021 gehad het. Terwyl die kinders ‘n aansoek gebring het dat die meester haar testament tot uitvoering bring, het hy die elektroniese handtekeninge van die getuies betwis.<\/p>\n\n\n\n

Die 2021-testament weerspie\u00ebl veranderinge in begunstigdes en bemakings vergeleke met die 2014-testament.\u00a0Ingevolge die 2021-testament word die bates soos ‘n huis op ‘n gholflandgoed buite Kimberley onder Mokgoro se kinders en kleindogter herverdeel.<\/p>\n\n\n\n

Mokgoro se kinders, waarvan haar seun Ithatheng Mokgoro ook die eksekuteur is,\u00a0het aansoek gedoen dat die meester van die hooggeregshof die 2021-testament as geldig aanvaar kragtens artikel 2(3) van die Wet op Testamente.<\/p>\n\n\n\n

Mmelesi het dit teengestaan en aangevoer die elektroniese handtekeninge van twee van Mokgoro se vertrouelinge as getuies is ongeldig, het nie aan formaliteite voldoen nie, en is nie behoorlik onderteken nie. Hy dring aan die getuies moes die dokument met die hand onderteken het en dat die testatrise en getuies dit in mekaar se teenwoordigheid op dieselfde datum moes onderteken.<\/p>\n\n\n\n

Tog het sy regsverteenwoordiger in beto\u00eb toegegee elektroniese handtekeninge is toelaatbaar ingevolge wetgewing, \u201cmaar in di\u00e9 besondere\u00a0geval was dit ongeldig\u201d.<\/p>\n\n\n\n

Mmelesi se redes vir di\u00e9 betoog was volgens die regter onduidelik. Mmelesi het selfs bewerings van bedrog gemaak, maar dit later teruggetrek.<\/p>\n\n\n\n

Mokgoro het haar vertrouelinge vooraf gebel en toe haar laaste testament aan ‘n e-pos geheg. Sy vra daarin dat haar vertrouelinge dit elektronies onderteken, wat hulle gedoen het.<\/p>\n\n\n\n

Mmelesi se regsverteenwoordiger het in beto\u00eb toegegee dat haar wense en die testament wel Mokgoro se voornemens was.<\/p>\n\n\n\n

Regter Lever het die 2021-testament aanvaar as die oorledene se laaste wettige testament, omdat\u00a0 Mokgoro\u00a0in haar skrywe bedoel het die 2021-testament is haar laaste testament.<\/p>\n\n\n\n

Mokgoro se\u00a0instruksies vir die uitvoering van die testament is ingevolge wetgewing duidelik. Ingevolge die Wet op Elektroniese Kommunikasie en Transaksies is elektroniese handtekeninge geldig, al het Mmelesi onsuksesvol aangevoer die Wet op Testamente laat dit nie toe nie.<\/p>\n<\/blockquote>\n\n\n\n

Die meester van die hooggeregshof word daarom gelas om die 2021-testament as geldig te aanvaar.<\/p>\n\n\n\n

Mmelesi se strafverhoor word op 20 Augustus in die streekhof in Kimberley hervat.<\/p>\n\n\n\n

Ikoon van vroue-prokureurs in Suid-Afrika<\/h3>\n\n\n\n

Mogoro is in Galeshewe in Kimberley gebore en het in 1970 aan die Ho\u00ebrskool St. Boniface matrikuleer. Terwyl sy as assistent-verpleegster en verkoopsdame gewerk het, het sy deeltyds vir haar regsgraad by die destydse Universiteit van Bophuthatswana studeer. <\/p>\n\n\n\n

Nadat sy haar meestergraad verwerf het, het syin 1990 haar LLM-graad in 1990 aan die Universiteit van Pennsylvania verwerf.\u00a0Sy het verskeie eredoktorsgrade van Suid-Afrikaanse universiteite verkry. <\/p>\n\n\n\n

Sy was ‘n lid van die Internasionale Vrouevereniging (Washington DC), die Internasionale Vereniging van Vroue-regters, die Internasionale Federasie van Vroue-prokureurs en die Suid-Afrikaanse Vereniging van Vroue-prokureurs. <\/p>\n\n\n\n
