\nYako? (46) was convicted by the Mthatha Regional Court on August 3, 2021 for ch\u00adarges
\nof theft and fraud.<\/p>\n\n\n\n
Yako, a duly qualified doc\u00adtor
\npractising in the district of Mthatha, entered into an agree\u00adment on July 31,
\n2011 with Industrial Dev\u00adelopment Corporation (IDC) representing Cross-Med
\nHealth Gro\u00adup and MPA Management Services.<\/p>\n\n\n\n
The contract was referred to as
\nExclusive Agency Ag\u00adreement. <\/p>\n\n\n\n
In February 2012, the IDC
\napproved a loan of R75.68 milli\u00adon to Cross-Med Health Care Cent\u00adre Pty Ltd for
\nthe establishme\u00adnt of a 52-bed private hospital facility in the Mthatha area
\nwhich is now operating as Mthatha Private Hospi\u00adtal. <\/p>\n\n\n\n
According to IDC loan agreement,
\nYako had to contribute R4 mill\u00adion into the project through his company called
\nOsteen Health Group Pty Ltd, half of which had to be allocated towa\u00adrds the
\nconstruction of the hospital str\u00aducture. <\/p>\n\n\n\n
Yako opened a Cross-Med bank
\naccount on behalf of the Cross-Med Health Group with First National Bank of
\nwhich he was the sole signatory in the bank account responsible for all
\npayments made from th\u00adis account.<\/p>\n\n\n\n
The company called Copperzone was
\nsuppos\u00aded to have been intr\u00adoduced to IDC as a business partner with Yako\u2019s
\ncompany, but it never was. The af\u00adorementioned company deposited more than R4.5
\nmillion into the Cross-Med bank account as a business partn\u00ader for business
\nrela\u00adted matters. <\/p>\n\n\n\n
He used R2.32 million from the
\nCross-Med Health Care Group ba\u00adnk account for his aggrandisement. He fu\u00adrther
\nopened his pri\u00advate company bank ac\u00adcount with a name si\u00admilar to that of the
\nCross-Med Health Group bus\u00adiness account by the name of Cross-Med Mthatha
\nPrivate Hos\u00adpital Pty Ltd wherein he redirected funds from the medical aid
\nschemes. <\/p>\n\n\n\n
The complaint was lo\u00addged with
\nthe Hawks\u2019 Serious Commercial Crime Investigation team at Mthatha in September
\n2013 for probing, which cu\u00adlminated in Yako\u2019s arrest on 28 November 2018. He
\nmade his short ap\u00adpearance in the Mthatha Magistrate\u00ad\u2019s Court on the very same
\nday and was releas\u00aded on R10? 000 bail. <\/p>\n\n\n\n
After a series of court
\nappearances, he was convicted and will be sentenced on 29 September 2021.?<\/p>\n\n\n\n
