The Mthatha Specialised Crime Court has, on September 23, convicted and
\nsentenced Patricia Nobantu Xaki (58) and Victoria Noyolo Mtatambi (54) on charg\u00ades
\nof theft. <\/p>\n\n\n\n
In October 2012 a co\u00admplaint was lodged by the Department of Justice ?
\nregarding the fraudulent activ\u00adities conducted by the department employ\u00adees
\n(Admin Clerks) at the Mthatha Magistrate\u2019s Court. <\/p>\n\n\n\n
The employees created fraudulent maintenance ghost files for none ?exis\u00adting
\npeople and made payment of maintena\u00adnce to the value of R700? 000 for their
\npersonal gain. <\/p>\n\n\n\n
The matter was repor\u00adted to Mthatha Serious Commercial Crime Inv\u00adestigation
\nUnit for further investigatio\u00adn. <\/p>\n\n\n\n
After thorough in\u00advestigation three clerks who were working? at the
\nmain\u00adtenance section were subsequently arrest\u00aded on April 30, 2021 and
\nappeared? the same? day at Mthatha Specialised Commerc\u00adial Crime Court where
\nthey were released on a warning.<\/p>\n\n\n\n
The matter was reman\u00added on several occas\u00adions. <\/p>\n\n\n\n
On September 23, 2021? Xaki and Mt\u00adatambi pleaded guilty on charges? of
\nth\u00adeft. Accused number 3, Kholosa Qupha (4\u00ad7) did not plead gui\u00adlty and as a result
\na se\u00adparation of trials was implemented. <\/p>\n\n\n\n
Xaki was sentenced to pay R6 000 or under\u00adgo three months\u2019 impris\u00adonment. In
\naddition, she was sentenced to five years\u2019 impri\u00adsonment, wholly suspe\u00adnded
\non condition that she does not co\u00admmit theft during the period of suspensi\u00adon.<\/p>\n\n\n\n
Mtatambi on the other hand was sentenced to pay R15? 000 or to undergo six mont\u00adhs\u2019 imprisonment, whol\u00adly suspended for five years on condi\u00adtion that
\nthe accused does not commit th\u00adeft during the period of suspension.<\/p>\n\n\n\n
The case against Qupha was remanded to November 30 for ?a separation of trial. <\/p>\n\n\n\n
