The High Court of South Africa: Eastern Cape Division,
\nsitting in Port St Johns has sentenced former traffic officer Fanele Nxuseka (38), 
\nto life imprisonment for the murder of his girlfriend.  <\/p>\n\n\n\n

The court sentenced him to a further 12 years
\nfor kidnapping.<\/p>\n\n\n\n

According to the National Prosecuting Authority (NPA) regional spokesperson, Luxolo Tyali, evidence presented in court revealed that Nxuseka, who is
\nmarried,  had been in an abusive
\nextramarital love relationship with the deceased, who did not disclose to him
\nthat she was on antiretroviral treatment (ARVs). <\/p>\n\n\n\n

\u201cNxuseka discovered on his own
\nthat his girlfriend was HIV-positive, and believed that she might have infected
\nhim and his wife.  On May 24, 2020, he
\nwent to the girlfriend\u2019s home in the Ngobozana area, in the district of
\nLusikisiki, and demanded that she leave with him.  The girlfriend left her cell phone with her
\nsister and told her that she might not be coming back alive,\u201d said Tyali. <\/p>\n\n\n\n

When the girlfriend did not return home, her family searched
\nfor her and found her lifeless body with multiple gunshot wounds, in the
\nneighbouring Mmangweni village.  Nxuseka
\nwas arrested the following day.\n<\/p>\n\n\n\n

\u201cBallistic tests conducted on the cartridges found on the scene
\npositively linked them to the firearm issued to Nxuseka by the state.\u201d<\/p>\n\n\n\n

<\/p>\n\n\n\n

Tyali further added that the the prosecution\u2019s case was concluded with a testimony of  a friend Nxuseka confided in following his discovery of his girlfriend\u2019s HIV status. <\/p>\n\n\n\n

\u201cAccepting the sentence, Eastern Cape Director of Public
\nProsecutions Barry Madolo, applauded the work of the prosecutor and
\ninvestigating officer in ensuring that gender-based violence is punished
\nwithout fear or favour, even if the perpetrator is a law enforcement official,\u201d Tyali concluded.<\/p>\n\n\n\n
