\nMEC Xolile Nqatha has welcome an East London High Court\u2019s decision to set aside
\nthe appointment of Dr Thandekile Mnyimba as Amathole District Municipality
\nmunicipal manager.<\/p>\n\n\n\n
The court ruling came after labour unions in ADM took the
\nmatter to court challenging Mnyimba\u2019s appointment as municipal manager on a new
\nfive-year term.<\/p>\n\n\n\n
The ADM council appointed Mnyimba on a new five-year
\ncontract effective June 1, 2022, despite vehement opposition to the decision
\nfrom labour unions, ANC provincial executive committee and the provincial
\ngovernment.<\/p>\n\n\n\n
The court ruling was delivered yesterday, June 28, as
\nMnyimba and ADM executive mayor Councillor Nceba Ndikinda, who were cited as
\nrespondents in the matter, attended the State of the District Address in
\nDutywa.<\/p>\n\n\n\n
\u201cI wish to welcome the judgement as I remain convinced that
\nif due process is not followed, anyone is bound to fail the test of legality
\nand therefore any other effort without proof of evidence is dead on arrival,\u201d
\nNqatha was quoted as having said in reaction to the court ruling.<\/p>\n\n\n\n
Nqatha said he felt vindicated by the judgement of the East
\nLondon High Court as he firmly believed in the rule of law and due process that
\nmust be always followed.<\/p>\n\n\n\n
\u201cThe Amathole District Municipality notes the draft order
\nthat is currently being circulated in the media and on social media purporting
\nto set aside the appointment of its municipal manager. As soon as the
\nmunicipality officially receives a copy of the signed court order it will
\nobviously respect the court order and if needs be seek legal advice,\u2019 said ADM
