Suspended principal from
\nBhonxa Senior Secondary Mzimkhulu Zibi (59), who is accused of repeatedly raping
\na Grade 12 learner (21), was denied bail by Tabankulu Magistrate\u2019s Court on
\nWednesday, June 29.<\/p>\n\n\n\n
The case was postponed to
\nJuly 28 for him to appear in the Kwa Bhaca Regional Court. <\/p>\n\n\n\n
MEC for Education, Fundile
\nGade, welcomed this decision with the hope that it would serve as a clear
\nreminder to everyone in the education sector that their call of duty requires
\nmore professionalism, parenting, and ethical conduct.<\/p>\n\n\n\n
\u201cThis decision is teaching us
\nall to understand deeply the responsibility bestowed to us and the societal
\nexpectation as we discharge our duties as public servants,\u201d said Gade.<\/p>\n\n\n\n
According to a statement
\nissued by departmental spokesperson, Malibongwe Mtima, the department has
\nprovided the affected learner with educational material, and it would continue
\nto make sure that she is studying in a conducive environment where her safety
\nis guaranteed.<\/p>\n\n\n\n
\u201cWhilst the alleged
\nperpetrator remains in police custody, the department is continuing with its
\ninternal disciplinary processes and the immediate suspension letter that the
\naccused submitted to the department has been rejected by Gade pending the
\nfinalisation of the case.\u201d<\/p>\n\n\n\n
Spokesperson for the National
\nProsecuting Authority (NPA), Luxolo Tyali, said Zibi would call the learner to
\nhis office at the school and he allegedly raped her twice on two different
\noccasions.<\/p>\n\n\n\n
\u201cHe would allegedly slap the
\ncomplainant with open hands and threaten her with death if she reported the
\nmatter. The victim reported the rapes to her peers and only reported them to
\nthe police after a teacher overheard her outburst to other learners in class.
\nZibi submitted an affidavit in support of his bail application and chose not to
\ngive oral evidence,\u201d said Tyali.<\/p>\n\n\n\n
According to him the state
\nled the evidence of the investigating officer Lieutenant Colonel Queenie
\nMaphipha, who strongly opposed bail.<\/p>\n\n\n\n
Tyali said Prosecutor
\nLuthando Nomandindi further argued that he failed to show exceptional
\ncircumstances for his release on bail.<\/p>\n\n\n\n
\u201cMagistrate Nozuko Mviko
\nagreed with prosecution that the interests of the victim, in this case, far
\noutweigh those advanced by Zibi for his release on bail and that it was not in
