An urgent
\napplication for the presiding officer to recuse himself from the trial of three
\nmembers of the Public Assets and Community Based Tenants and Owners Association
\n(PACTOA), has delayed their bail application.<\/p>\n\n\n\n

The trio
\nmade their second court appearance before the Mthatha Magistrate\u2019s Court on October 13, for what was supposed to be a formal bail application. But one of the accused, Zamikhaya Songca, brought an application for the
\npresiding Magistrate, Mthuthuzeli Mnge, to recuse himself citing his proximity to
\nhis family.<\/p>\n\n\n\n

Songca\u2019s co
\naccused are Bongani Cikolo and Sicelo Nkqayi.<\/p>\n\n\n\n

They are
\nfacing charges of fraud, alternatively theft in connection with the alleged invasion
\nand forceful eviction of tenants from eleven properties belonging to the
\nEastern Cape Development Corporation in Mthatha in 2017. It is further alleged that the association claimed monthly rentals from tenants of the invaded properties for their personal use.<\/p>\n\n\n\n

Songca, in
\nhis affidavit, had argued that his relative was a sister-in-law to the
\npresiding magistrate and there were many members of the Songca family that
\nMagistrate Mnge was close to.<\/p>\n\n\n\n

In
\ndismissing the recusal application, Mnge said he did not know the accused and
\nhe was seeing him for the first time in court. He further said he had no
\nknowledge of the applicant\u2019s relative he claimed to be his sister-in-law.<\/p>\n\n\n\n

\u201cThe law
\nsays there must be a direct or indirect link between the presiding magistrate
\nand the applicant for recusal to be granted. There is no link between me and
\nthe applicant. The application by the applicant is based on whimsical and
\nmorbid ground and is thus refused,\u201d Mnge ruled.<\/p>\n\n\n\n

The court
\nhas scheduled the formal bail application for October 19, 20 and provisionally
