{"id":46584,"date":"2023-08-29T10:35:00","date_gmt":"2023-08-29T08:35:00","guid":{"rendered":"https:\/\/novanews.co.za\/mthathaexpress\/state-closes-its-case-in-the-enyobeni-tavern-owners-trial-20230829\/"},"modified":"2025-03-21T12:02:59","modified_gmt":"2025-03-21T10:02:59","slug":"state-closes-its-case-in-the-enyobeni-tavern-owners-trial-20230829","status":"publish","type":"post","link":"https:\/\/novanews.co.za\/mthathaexpress\/state-closes-its-case-in-the-enyobeni-tavern-owners-trial-20230829\/","title":{"rendered":"State closes its case in the Enyobeni Tavern owners\u2019 trial"},"content":{"rendered":"\n<p>The state led its last witness in the case against the Enyobeni Tavern couple Siyakhangela and Vuyokazi Ndevu sitting in the East London Regional Court last week.<\/p>\n\n\n\n<p>Police Detective Captain Gerhard Swart was the last witness to be led by senior state prosecutor Advocate Tango Pangalele during the trial.<\/p>\n\n\n\n<p>Among the evidence led was from a neighbour of the Ndevu couple, eyewitnesses who were present at the establishment when the incident occurred, Eastern Cape Liquor Board officials and the CCTV footage taken from the establishment on the fateful night of 26 June 2022.<\/p>\n\n\n\n<p>\u201cThe two are charged with two offences of selling or supplying intoxicating liquor to persons under the age of 18 years, and responsibility for conniving with and permitting employees and agents to sell or deliver intoxicating liquor to persons under the age of 18 years.\u201d<\/p>\n\n\n\n<p>\u201cThey will return to court on October 24 and 25 for the defence case. They have pleaded not guilty to both charges,\u201d said National Prosecuting Authority regional spokesperson Luxolo Tyali.<\/p>\n\n\n\n<p>About the main case of the deaths of 21 young people in the Enyobeni Tavern, an inquest will resume in the East London Regional Court on 31 August 2023.<\/p>\n\n\n\n<p>\u201cThe Eastern Cape Director of Public Prosecutions (DPP), Barry Madolo, decided that an inquest be held by a Regional Court Magistrate to establish if anyone can be held criminally liable, by commission or omission, for the deaths. At this moment, it is unclear what caused the incident, and hence, the state declined to prosecute,\u201d added Tyali.<\/p>\n\n\n\n<p>According to Tyali, the matter was referred for formal inquest, which is inquisitorial in nature. It will assist the state in establishing the cause of death to reach the appropriate legal conclusion.<\/p>\n\n\n\n<div 'helvetica=\"\"
