strike: Kouga Municipality strikes back"},"content":{"rendered":"<p>Kouga Municipality has obtained an urgent interim Labour court order interdicting and<br \/>\nrestraining all employees from continuing with the illegal, unlawful and<br \/>\nunprotected strike.\u00a0<\/p>\n<p>In<br \/>\nJanuary 2021, SAMWU \u2013 the biggest labour union in Kouga Municipality \u2013 obtained<br \/>\na strike certificate from the SALGBC in which they demanded a COVID-19<br \/>\nallowance.\u00a0<\/p>\n<p>SAMWU<br \/>\nthen subsequently gave notice to the Municipality to embark on a strike, in<br \/>\nwhich the Municipality then referred an application and interpretation dispute<br \/>\nto the CCMA.<\/p>\n<div contenteditable=\"false\" data-embed24=\"Images\" data-pos=\"left\" id=\"embed_ae47d5dd\">\n<div class=\"slide\"><img decoding=\"async\" alt=\" \" data-smallsrc=\"https:\/\/cdn.24.co.za\/files\/Cms\/General\/d\/3693\/577686c7bb1b4c87a39a4edcd1441f05.jpg\" <\/div>\n<\/div>\n<\/div>\n<p>SAMWU<br \/>\nand the Municipality then agreed as per a settlement agreement to finalise the<br \/>\nsaid dispute at the CCMA before SAMWU can embark on a strike.\u00a0<\/p>\n<p>This<br \/>\nwas then made an order of the Labour Court.\u00a0<\/p>\n<p>The<br \/>\nCCMA then subsequently ruled that they do not have jurisdiction over the case,<br \/>\nand then transferred the case to the SALGBC.\u00a0<\/p>\n<p>SAMWU<br \/>\nthen immediately embarked on an illegal strike after receiving the CCMA ruling<br \/>\nas they deemed the matter as finalised.\u00a0<\/p>\n<p>The<br \/>\nMunicipality saw this action as <em>mala fide<\/em> and the strike was declared<br \/>\nunlawful and unprotected.\u00a0<\/p>\n<p>SAMWU<br \/>\nand all the striking employees were advised as such on two occasions, however,<br \/>\nthe strike continued unabated.\u00a0<\/p>\n<p>The<br \/>\nMunicipality then approached the Labour Court and on 16 March 2021, the Municipality<br \/>\nobtained an interim Labour Court interdict declaring the strike as unlawful and<br \/>\ninvalid and interdicting and restraining all striking employees from continuing<br \/>\nwith the strike.\u00a0<\/p>\n<p>The<br \/>\ndispute referred to the CCMA, which in turn has been referred to the Bargaining<br \/>\nCouncil, must first be finalised as per<br \/>\nthe Labour Court ruling, as has been reiterated by the Municipality numerous<br \/>\ntimes.\u00a0<\/p>\n<p>\u201cThe<br \/>\nprincipal of no work no pay will apply to all striking employees,\u201d said Kouga<br \/>\nExecutive Mayor, Horatio Hendricks.\u00a0<\/p>\n<p>\u201cServices<br \/>\nshould be back to normal from tomorrow, and we thank the public for their<br \/>\npatience.\u201d<\/p>\n<h6>Source: Kouga
