The Gqeberha Regional Court has sentenced Jeffreys Bay resident, Sipho Matshingila (49), to an effective 15 years’ imprisonment for the unlawful possession of firearms and ammunition, following two separate incidents five years apart involving the same type of firearm.\u00a0<\/p>\n\n\n\n
Luxolo Tyali, National Prosecuting Authority spokesperson, said that Matshingila was convicted on two counts of unlawful possession of a firearm, for which he was sentenced to 15 years’ imprisonment on each count, and two counts of unlawful possession of ammunition, for which he received three years on each count. <\/p>\n\n\n\n
He said that the court ordered the sentences to run concurrently, resulting in an effective 15-year imprisonment. <\/p>\n\n\n\n
Tyali said that he was also declared unfit to possess a firearm.<\/p>\n\n\n\n
He said that on 24 August 24 police received information that Matshingila had a firearm and a search of his home in Mandela Bay Location led to the recovery of a .38 Special Revolver with five rounds of ammunition.\u00a0<\/p>\n\n\n\n
However, Tyali said that the matter was struck off the roll in February 2018 pending ballistic evidence, and the case went cold. <\/p>\n\n\n\n
In a surprising turn of events, he said that on 23 September 2022, police once again received intelligence that Matshingila had an unlicensed firearm.\u00a0<\/p>\n\n\n\n
He said that a second search of his home revealed another .38 Special Revolver with five rounds of ammunition identical in type to the previous case, and he was rearrested and charged.<\/p>\n\n\n\n
“Matshingila pleaded not guilty to all charges and challenged the legality of the police search, claiming it was conducted unlawfully,” said Tyali.<\/p>\n\n\n\n
He said that the prosecution, led by Regional Court Prosecutor Johan Jansen, countered this defence by presenting a valid search warrant and leading the testimony of the officers involved in both operations. <\/p>\n\n\n\n
“Ballistic evidence linking the recovered firearms to Matshingila was also presented, resulting in the court finding him guilty as charged on 3 July, this year, and sentencing him on 16 July. The court also considered Matshingila’s previous conviction for possession of drugs in 2014, for which he was sentenced to a R1 000 fine or 80 days’ imprisonment, suspended for five years,” said Tyali.<\/p>\n\n\n\n
Welcoming the sentence, Eastern Cape Director of Public Prosecutions, Barry Madolo, commended the investigative team and prosecution for their persistence in pursuing the matter despite the initial delays.<\/p>\n\n\n\n
“This sentence sends a strong message that unlawful possession of firearms will not be tolerated. Firearms in the wrong hands pose a serious threat to public safety.
