Regter Melanie Holderness van die hoogeregshof in Kaapstad het uitspraak voorbehou en sal na verwagting in die volgende twee maande besluit of die projek, bo die Helshoogtepas, sal kan voortgaan en of die 2023-omgewingsmagtiging vir die projek hersien moet word.<\/p>\n\n\n\n
Die Stellenbosch-belangegroep (SBG) vra die hof om \u2018n bevel uit te reik dat die omgewingsmagtiging, wat in November 2023 deur die Wes-Kaapse departement van plaaslike regering, omgewingsake en ontwikkelingsbeplanning ingevolge \u2019n aansoek in Februarie 2021 toegestaan is, nie geldig is nie.<\/p>\n\n\n\n
Die aanvanklike goedkeuring was vir \u2019n berg-vakansieoord.<\/p>\n\n\n\n
Die oorspronklike ontwikkeling sou \u2019n klein hotel, swembad en 15 chalets behels en \u2019n voetspoor van een hektaar op \u2019n eiendom van 30 ha wees. Die projek is sedertdien aan verskeie ontwikkelaars verkoop en die omvang daarvan is vergroot.<\/p>\n\n\n\n
SBG bevraagteken ook die Stellenbosh-munisipaliteit se besluit om \u2018n stuk grond met die ontwikkelaars te verruil.<\/p>\n\n\n\n
Volgens die munisipaliteit was die 4,69 hektaar-grond-ruiling gelykstaande aan en gewaardeer op R1 950 000 en is in Julie 2024 goedgekeur.<\/p>\n\n\n\n
